Global Positioning Systems (GPS) have provided police with a new tool with which they can locate and keep track of the movements of criminals while reducing the number of man hours required. They no longer have to actively track criminals in order to establish their whereabouts and develop patterns of their activities. This can all be done electronically.
Much the same way that private investigators use the same tools to help in their cases of catching cheating spouses in action, police can use the same technology to develop cases against criminals. The big difference is the permissions needed to track vehicles that in some instances may seem to be against the law the police are trying to uphold.
In cases where one spouse wants to track the locations of the other, in order to legally attach a GPS tracking device to a vehicle, a private investigator needs permission. If both spouses have their names on the title of the vehicle, they only need the permission of one of them. The spouse seeking their help will likely give them that permission, making their tracking of the vehicle legal, even without the offending spouse’s knowledge.
How Does a Tracking Device Work?
Typically, the tracking devices are battery operated and placed surreptitiously on the vehicle. Batteries will need to be replaced in about a week, also without attention, and private investigators will still need people in the field to do this, as well as obtain other types of evidence the injured spouse will need to bolster their case.
When law enforcement wants to track an offender’s movements, in most cases they will require a warrant signed by a judge, and then only if they can show probable cause that the need is justified.
However, it isn’t just the use of tracking devices that help keep track of both offenders and cheating spouses. There is also the equipment and software needed to recover the information and translate it into something that can be used. Investigators in the field will also be needed to prove the offender was at the same location as the vehicle. It isn’t enough to electronically track a vehicle’s location. It will have to be shown who took that vehicle to the location.
The same issues face police when they track a vehicle. The GPS tracking equipment will only prove that the vehicle was at certain locations at certain times, but not who was driving the vehicle. Without having eyes on the individual being tracked, they can only prove their vehicle was there.
The advantage is that fewer investigators are needed when following a suspect as they can ascertain their location electronically and if they get lost when following them the tracking information can be used to reestablish contact. Additionally, more investigators involved in an exercise translate into more opportunity for the suspect to realize they are being followed and take evasive measures.
When used correctly, GPS tracking devices can be a great benefit to law enforcement, but they can also be unreliable if all of the measures to verify the activities of a suspect are not used appropriately.
